New energy-saving measures: What obligations do property owners have?
To save energy and minimize the impending gas shortage, the federal government has passed various energy-saving measures. Part of the regulations has been in force since September 1, 2022, and the second part has applied since October 1, 2022. Property owners are obligated to contribute to the savings. Affected are public and private buildings as well as commercial properties.
Here is an overview of the adopted measures affecting the private sector:
- The temperature in the apartment can be lowered. The landlord is not obligated to ensure a specific minimum temperature in the property. Before the energy-saving measures came into effect, landlords had to ensure that a temperature of at least between 20 and 22 degrees Celsius could be reached in the private apartment. Due to the new energy-saving measures, they are temporarily exempt from this obligation. Tenants must ensure that the apartment is sufficiently ventilated and adequately heated so that no damage occurs in the apartment. Above all, it is important that no mold develops.
- It is not permitted to heat private swimming pools and bathing pools with gas and electricity. This applies to both indoor and outdoor swimming pools. Whirlpools and above-ground pools are also affected by this measure. The legislator has provided an exception for pools used for therapeutic applications. Swimming pools, hotel pools, rehab centers, or similar facilities are exempt from this energy-saving measure and can continue to be heated as before.
- Owners of larger residential buildings (apartment buildings) and gas suppliers have a duty to provide information. They must inform their tenants or customers in a timely manner about the expected energy consumption and the associated costs. In addition, they must provide information on potential energy-saving opportunities.

Medium-term energy saving measures
In addition, medium-term energy-saving measures were adopted, which have been in effect for two years since October 1st. The goal is to increase energy efficiency in buildings and thereby save energy. The following measures are planned:
- Buildings with gas heating systems must undergo an annual heating inspection. The heating systems should be set to a lower supply temperature and the temperature should be reduced during the night. It is important that all possibilities for heating optimization are sensibly implemented and thus contribute to saving energy.
- Large real estate properties equipped with a central natural gas heating supply must perform a hydraulic balancing. This helps to distribute the water optimally within the radiators, which should allow the heating systems to operate as efficiently as possible.
- Buildings equipped with an inefficient and uncontrolled heating pump (natural gas) must be fitted with new and energy-saving heating systems.
