More and more homeowners are considering private video surveillance, whether to deter burglars or to monitor their own property. However, what is well-intentioned can quickly become legally problematic, especially if neighboring properties or public paths end up in the camera's field of view. In this guide, we examine the most important questions regarding the use of surveillance cameras at private residences.

What is permitted and where private video surveillance has its limits

Surveillance cameras on your own home can provide a sense of security. However, there are clear rules of the game. Private video surveillance is generally permitted as long as it is limited to your own property. Areas such as sidewalks, streets, the common areas of an apartment building, or neighboring property must not be captured, not even at the edge of the image.
This is regulated by the General Data Protection Regulation (GDPR) and the Federal Data Protection Act. The basis is that, as an owner, you have a legitimate interest in protecting your property. However, this interest must be carefully weighed against the personal rights of uninvolved third parties. Burglary prevention alone is not automatically sufficient, even if nationwide more than 78,000 residential burglaries are reported annually.

Long-term archiving without a specific reason would be a violation of data protection regulations.

Avoiding legal pitfalls before installing the camera

Before the camera is mounted on the house wall, a few important points should not be overlooked. The basis of any camera installation is a clearly defined surveillance area, which should be documented in writing. This is the only way to prove in the event of inquiries or audits that the deployment was permissible under data protection law.

Particularly strict rules apply in apartment buildings. Anyone wishing to film in common areas needs the consent of all residents. According to the Federal Court of Justice, a majority decision is not sufficient; the consent of every single party is important.
